Terms of Trade

City Transfer Services Ltd Terms of Trade

 

Quotes are based on itineraries submitted either by fax or email only and are subject to NZ driving laws + vehicle availability.

 

Confirmation of your request for services or reservations must be in writing either by fax or email addressed to City Transfer Services Ltd.

 

City Transfer Services Ltd will in return Confirm your confirmation in writing for services & reservation either by fax or email addressed to you.

Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of service.

Quotes are Valid for 7 days only.

Written confirmation of acceptance of quote is acceptance of our terms of trade and conditions

If the itinerary changes City Transfer Services Ltd will be happy to provide a revised quotation. Alterations to itineraries by customers once the job has commenced that involve extra distance and/or time will incur additional charges. Whilst we make every effort to anticipate increased costs”

 

City Transfer Services Ltd reserves the right to recover fuel, levies and other unexpected price increases of which we were unaware when submitting our quotation.

 

Please note: Charters that deviate from the quoted times may incur an additional charge of $150.00 + GST to mitigate the cost of covering other bookings.

 

Any trips that travel over a public holiday, $199.00 + GST will be added to the quoted rate for each day that falls on a public holiday.


Please familiarize yourself with our standard contract terms and conditions:


Payment (1)

1) A deposit is required 7 days after the confirmed booking.

2) Bookings made within 7 days of booking require full payment.

3) A deposit of $100.00 for charters under $1000.00 is required. (Non Refundable Cancellations made less than 14 days prior to the Charter Date for one-day trips)

4) A deposit of 25% of the quoted amount for charters $1000.00 and up is required. (Non Refundable Cancellations made less than 59 - 15 days prior to the Charter Date for extended trips)

5) Final payment for charter service is due and payable at least 14 days in advance of the charter date for extended touring, Day charters require full payment 7 days in advance.

6) Charters booked less than two weeks prior to departure must be paid in full with a money order, bank credit or cheque within 7 days of booking.

7) When making payment, please indicate on your check or other mode of payment, the date of your trip and your Charter Confirmation Order Number to insure proper credit.

 

Prices Subject to Change

All prices quoted in the written confirmation of quote are subject to change under the circumstances described herein, but shall not be increased, in the aggregate, by more than twenty percent (20%).

Quotes are Valid for 7 days only.


1) If the price of diesel fuel increases by more than twenty percent (20%) between the date of the confirmation and the date of the charter, the Company may increase the prices quoted in the confirmation by an amount equal to the product of (i) the per gallon increase in diesel fuel over twenty (20%), and (ii) the estimated number of litres to be used in the charter.

2) If there is a change in the local laws or regulations between the date of the confirmation and the date of the charter that (i) require material modifications be made to the motor coach chartered, or (ii) cause the Company to incur material additional or increased expenses in providing the charter service, the Company may increase the prices quoted in the confirmation.

 

Cancellation The Chartering Party must notify the Company of cancellations:

1) There will be no cancellation fee if the cancellation is made more than 14 days prior to the Charter Date for one-day trips.

2) Cancellations made less than 14 days prior to the Charter Date for one-day trips will be subject to a 25% cancellation fee PER BUS, Cancellation fee PER BUS PER DAY:

3) Cancellations made less than 59 - 15 days prior to the Charter Date for extended trips will be subject to a 25% cancellation fee PER BUS.

4) Cancellations made less than 14 days prior to the Charter Date for extended trips will be subject to a cancellation fee of 50% of the total charter fee. Cancellation fees are based on the agreed fix Charter fee or rate upon conformation or booking.

 

Allowances: No allowances or reductions of any kind shall be made in the rates set forth on this order.

 

Additional Charges When the Chartering Party requests any change in service that results in an increase in Kilometres or hours to that specific charter, an additional charge may be necessary for that additional service. Any change resulting in a reduction of charges will be subtracted from the estimated cost and will be refunded to the Charter Party after completion of trip. Tolls, highway fees, etc. will be separate and additional.

 

Extended Day Trips A detailed itinerary is required for extended day trips at least two weeks prior to departure. Itineraries are subject to review by a safety officer of the Company. Prices are subject to change based on the final itinerary. The Chartering Party is responsible for reserving a room(s) for the driver(s). If staying at an expensive hotel or other accommodations, please contact CTS.

 

Driver Hours New Zealand Ministry of Transportation safety regulations prohibit drivers to be on duty more than Thirteen (13) hours per day, ten (10) of which are for driving (including a 30-minute pre- and post-trip vehicle inspection & cleaning). The driver must be given Ten (10) consecutive hours off before he/she may resume his/her duties.

 

Damages to Buses The cost of repairing damage to buses resulting from the conduct and actions of passengers on that specific charter shall be charged to the Chartering Party and is payable as soon as such cost is determined.

 

Arrival Time The time of arrival at starting point, destination, or return to point of origin cannot be guaranteed. Operators are carefully selected and have instructions to drive at all times at a speed within the limits prescribed by law and compatible with safe operation. Unusual road, traffic and weather conditions are beyond Company control:

 

Equipment furnished by the Company is thoroughly inspected before being assigned to the charter service to insure uninterrupted service. If for some reason beyond the control of the Company, a mechanical failure makes necessary the replacement of a bus originally assigned to the charter service, the replacement bus may be of a different type.

 

Unforeseen circumstances In the event of a mechanical failure or driver health issues, City Transfer Services Ltd will arrange an alternative transport or driver at our expense.  This shall be the extent of responsibility by City Transfer Services Ltd for any consequential loss that may result. City Transfer Services Ltd can in no way be held responsible or liable for events beyond its control such as weather, road closures, ferry cancellations, etc.

 

Baggage The company recommends personal travel insurance and assumes no responsibility whatsoever, for any personal property. Baggage and all other personal property will be handled only at passenger's own risk. Passenger's baggage shall be transported subject to the available accommodations (as determined solely by the Company)

 

Objectionable Persons The Company reserves the right to refuse to transport persons under the influence of intoxicating liquor or drugs, or who are, or are likely to become, objectionable to other persons.

 

Conduct of Passengers shall not interfere with the operator in the discharge of his duty or tamper with any apparatus or appliance on the bus.

Firearms, Explosives and Firework: Possession of firearms, explosives and fireworks (whether in baggage or on the person) are strictly forbidden on/in the motor coach: Unusual Cleaning When the charter trip is such that a greater than normal amount of time and material will be necessary to clean the bus properly, the Company, at its option, may require additional cost to cover such additional time and materials.

 

Limitation of Liability NEITHER PARTY SHALL BE LIABLE IN ANY EVENT, OR FOR ANY REASON, INCLUDING BREACH OF THIS AGREEMENT, EITHER DIRECTLY OR INDIRECTLY, TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS ARISING OUT OF THIS AGREEMENT, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Neither party shall be liable for failure or delay in performing obligations set forth in the charter agreement, and neither party shall be deemed in breach of its obligations, if such failure or delay is due to natural disasters, strike, lockout, or other industrial or transportation disturbances, law, regulation or ordinance, or any causes reasonably beyond the control of such party. We act only as an agent in arranging transportation, accommodations, or any optional sightseeing tours, cruises, flights, etc., and as such are not responsible for any damages, loss, delay, injury, or accident due to weather, or any act of default of any company or person engaged in providing service included in our tours. This company, and its agents, shall not be responsible for any injuries, damages, or losses caused to any traveller in connection with terrorist activities, social or labour unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions, or developments, or any other actions, omissions or conditions outside our control. Restitution for damages, if any are claimed, shall be sought directly from the suppliers.

 

Entire Agreement The Charter Agreement constitutes the entire agreement between the parties and supersedes any and all other agreements, either oral or written with respect to the subject matter hereof.

 

No Assignment The Chartering Party may not assign this Agreement or any of their respective rights, interests, duties, or obligations hereunder without the prior written consent of the other party: The Company may assign this Agreement and any of its rights, interests, duties or obligations hereunder without the prior written consent of the chartering party.

 

Prohibited Items The following items are prohibited without the written consent of the Company: (1) Decorations (2) Alcoholic Beverages (3) Smoking (4) Glass containers (5) Golf shoes or other shoes with spikes (6) Fuel containers (8) Generators

 

No Smoking In accordance with the law and the interest of the health and comfort of our passengers, smoking is not allowed on board the vehicle. We have scheduled photography stops, coffee breaks, and lunch stops to give those who smoke opportunities to do so.

 

No alcohol is allowed on the vehicle at any time. We reserve the right to refuse boarding under such circumstances that these policies are not followed.

 

The Tour Director or Driver in charge may dismiss any person from any tour at any time should his or her conduct not be in harmony with the rest of the passengers; no further obligation will be assumed by this company or anyone in their employ.
